  1. USERS AND USE OF THE WEBSITE

The access and use of the GOR FACTORY S.A. website (hereinafter “the Company”) confers the status of “User”, who accepts, through said access, the General Conditions of Use reflected herein, in full and without any type of reservation. These Terms of Use will be applicable irrespective of any General Terms and Conditions of Business that may be applicable.

The User must carefully read this Legal Notice whenever he/she accesses this Website, since it will be subject to modifications or updates. The conditions of use of this Website are governed by the principles of legality and good faith, and the User undertakes to use the services and information provided therein, in accordance with the Law, morality, public order and good customs.

GOR FACTORY provides access to a great deal of information, services, programs and data (hereinafter “content”) on the Internet that the USER can access. The USER assumes responsibility for the use made of the website. This responsibility extends to any registration which may be necessary to access certain services or content.

In the event of such registration, it is the USER’s responsibility to provide true and lawful information. As a result of this registration, the USER may be given a password for which they are responsible, undertaking to use it carefully and confidentially. The USER undertakes to make appropriate use of the content and services (such as chat services, discussion forums or newsgroups) and not use these to: (i) engage in activities that are illegal, unlawful or contrary to good faith and public order; (ii) spread content or propaganda of a racist, xenophobic or pornographic-illegal nature, or which glorify terrorism or violate human rights; (iii) damage the physical and logical systems owned by GOR FACTORY, its suppliers or third parties, introducing or spreading computer viruses or any other physical or logical system capable of causing the aforementioned damage; (iv) attempt to access and/or to use the email accounts of other users and to modify or manipulate their messages. GOR FACTORY reserves the right to remove any comments and contributions that violate respect for human dignity, or that are discriminatory, xenophobic, racist, or pornographic; or that constitute an attack against youth or childhood, order or public safety; or that, in its opinion, are not suitable for publication.

 

  1. PURPOSE

Gor Factory S.A. (“the company”) (GOR FACTORY.) (hereforth “the provider”), responsible for the website, provides users with this document in compliance with the obligations stipulated by Law 34/2002, on Information Society Services and Electronic Commerce (LSSI-CE), as well as to inform all users of the website of the conditions of use of the these.

Any person accessing this website assumes the role of user, committing to the observance and strict compliance with the provisions set forth herein, as well as any other legal provision that may be applicable.

The provider reserves the right to modify any of the information that appears on the website, without any obligation to give prior notice or inform users of said obligations, with publication on the provider’s website understood to be sufficient.

 

  1. Liability

The provider is exempt from any liability for the information posted on its website, provided that this information has been altered or introduced by an external third party.

The website provider may use cookies (small pieces of information that the server sends to the computer of the person accessing the page) to perform certain functions that are considered essential for the correct operation and visualisation of the site. The cookies used on the website are, in any case, temporary, for the sole purpose of making later transmission more efficient, and disappear shortly after the user ends the session. Under no circumstances will cookies be used to collect personal information.

From the customer’s website it is possible to be redirected to content of third party websites. Since the provider cannot always control the content posted by third parties on its websites, it does not assume any responsibility for such content. Notwithstanding and in compliance with the provisions in Art. 11 and 16 of the LSSI-CE (Spanish Law on Information Society Services and Electronic Commerce), the provider is available to all users, authorities, and law enforcement authorities and actively collaborates in the removal or blocking of all content that might affect or violate national or international law, rights of third parties, or morality and public order. In the event that a user believes any content on the website to pertain to this classification, they are asked to notify the website administrator immediately.

This website has been reviewed and tested in order to work properly. Proper operation can usually be guaranteed 24 hours a day, 365 days a year. However, the provider does not rule out the possibility that there may be certain programming errors or that causes of force majeure, natural disasters, strikes, or similar circumstances preclude access to the website.

 

  1. Intellectual and industrial property

The website, including but not limited to its programming, editing, compilation and other elements necessary for its operation, designs, logos, text and/or graphics, are the property of the provider, or, where necessary, the provider has been expressly licensed or authorised by the authors. All Website content is duly protected by intellectual and industrial property rights and registered in the corresponding public registers.

The provider is deeply committed to compliance with Spanish regulations on the protection of personal data and REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT and OF THE COUNCIL of 27 April 2016, Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights, and guarantees full compliance with the obligations provided.

The provider makes available to users an information clause informing users, at the time they provide their personal data.

When personal data is collected via https://gorfactory.com/, the user will be solely responsible in the event of filling in the forms with false, inaccurate, incomplete or outdated data, being previously informed, clearly and unequivocally, that the Personal Data provided will be processed to send you advertising related to our products and services by any means (post, email or telephone) and invite you to events organized by the company. The data provided will be kept as long as you do not request to opt out of said activity. Data shall not be disclosed to any third parties unless it is legally required. You have the right to obtain confirmation about whether GOR FACTORY is handling your personal data, therefore you have the right to access your personal data, rectify inaccurate data or request its deletion when the data is no longer necessary.

The right to complain to a supervisory authority: You can lodge a complaint about data protection with the competent supervisory authority. However, we would appreciate it if you would offer us the opportunity to address the issues you are dissatisfied with before addressing the ICO, and we kindly ask you to contact us in the first instance. This request should be addressed to our DPO at the email address stated above in point 1.

 

  1. Applicable Law

These General Terms and/or Conditions of Contract are governed by Spanish Law.

Likewise, the Users expressly accept that the resolution of any dispute that may arise, with respect to its validity, execution, compliance or resolution, in whole or in part, they submit, expressly waiving any other jurisdiction that may correspond to them, they submit to the Jurisdiction of the Courts and Tribunals of the user’s domicile for any issues that may arise or actions that may be exercised derived from the provision of the website service, its services, contents and on the interpretation, application, compliance or non-compliance with the provisions herein. In the event that the User is domiciled outside a member state of the European Union, GOR FACTORY and the User, expressly waiving any other jurisdiction that may correspond to them, submit to the Jurisdiction, under the jurisdiction of the Courts and Tribunals of the domicile of the commercial establishment which corresponds to GOR FACTORY.

 

This document constitutes the complete and entire expression of the agreement between GOR FACTORY, and the User, and replaces all previous covenants, commitments, representations or agreements, both written and oral, that have previously existed between the two.
